Stejarii – Residential Club & Stejarii Collection

Welcome to the Stejarii mobile application!

We invite you to carefully read both the Terms and Conditions, as well as the Privacy Policy regarding how personal data is processed in the context of using the application and which can be consulted HERE. These documents regulate both the way of using the Application and the relationship with its users.

The design and content of STEJARII application belong exclusively to the company MASTERANGE ROMANIA S.R.L. (hereinafter “Masterange”), with registered office in 24-26 Nordului Road, 1st district, Bucharest, registered with the Trade Registry Office attached to Bucharest Court under number J2003003330402, having CUI 15262492, tax attribute RO and are protected by intellectual property legislation.

I. DEFINITIONS

The term “Application” used in this document refers to STEJARII mobile application made available to the residents of Stejarii – Residential Club and Stejarii Collection and their guests.

User – natural person who has or obtains access to the Content, through the means of communication made available by Masterange (electronically) within the Application, respectively the resident of Stejarii – Residential Club and/or Stejarii Collection and his/her guests – adults and/or children.

Account – section of the application consisting of an e-mail address and a password that allows the user, as the case may be, access, viewing, consulting, evaluating, querying information and submitting the request and which contains information made available by him/her.

To use Stejarii Application, there are several types of Accounts (the account represents the access path to Stejarii Application), respectively Adult Account and Associated Accounts (i.e. Child Account, Pet Account):

Adult Account – can be created and used by the Lessee (the holder of the lease agreement/the representative of the legal entity, having the capacity of legal/conventional representative/employee/proxy and who is simultaneously the holder of the right to use the housing unit according to the lease agreement) and/or by the Occupant, a natural person, to whom the Lessee has granted the right to use the housing unit according to the lease agreement (hereinafter “Adult”);
Child Account – can be created by sending an invitation by the holder of an Adult Account and can be used by the child to whom the Adult as parent/guardian/legal representative has decided to grant the right to create an account in Stejarii Application (“Child”).
Pet Account – can be created and managed by an Adult Account and includes information about the Adult’s pet.

The Adult will open an Adult Account:

in the Application downloaded on THE own device, by going through the appropriate steps, and later by sending a request to the Concierge Office.
as a result of receiving an invitation from another Adult Account, by entering in the downloaded Application the unique code received from the e-mail address indicated in the received invitation.

The holder of an Adult Account can also open a Pet Account, dedicated to the pet.

The Adult Account holder is responsible for sending the invitation for the creation of the Adult Account by the invited adult (either an occupant of the building or another person authorized by the resident to have access to the functionality of the Application). Also, by creating the Adult Account, its holder will have access to the functionalities of the Application. The Adult Account Holder is responsible for Masterange for all the actions undertaken by accessing the functionalities of the Application (including but not limited to the possibility of unlocking the door – access to the building where the apartment leased by the resident is located, making a claim to the Concierge Office and bearing, as the case may be, the related costs, etc.). The lessee – owner of the Adult Account undertakes to inform without delay Masterange – Concierge Office regarding the withdrawal of the right of access to the premises of the complex/building of an Adult, when such a situation arises (for example, he/she no longer lives in Stejarii), otherwise being responsible for all and any his/her actions made through the Application.

The Adult Account holder, by submitting the invitation for the creation of the Child Account, declares that he/she is the parent/legal representative (e.g. Guardian) of the child to whom he/she allows the creation of the Child Account, with access to a limited series of functionalities and actions in the context of using the Application, respectively : unlocking the door, events that are addressed to the entire community regardless of age, program privileges, offers and services. Also, the resident holder of the Adult Account is responsible to Masterange for all the actions undertaken by the child by accessing the functionalities of the Application available for the Child Account, and undertakes to inform without delay Masterange regarding the termination/withdrawal of the child’s access to the Application’s functionalities, otherwise being responsible for all and any of his/her actions carried out through the Application.

By „Content” we understand:

all the information in the application that can be viewed, respectively accessed and used by using the Application;
the possibility of unlocking (opening) the door of the building where the resident has leased an apartment, as well as pedestrian access to Stejarii – Residential Club and Stejarii Collection (turnstiles), according to the procedure for allowing access through the Application;
Concierge services offered by Masterange within Stejarii – Residential Club and Stejarii Collection, respectively: initiating claims, calling Concierge Office, providing feedback on the services provided, ordering a taxi (Black Cab) or booking a shuttle bus to Otopeni Airport;
The benefits offered through the Privilege Program intended for the residents of Stejarii – Residential Club and Stejarii Collection (including enrollment in this program);
Information related to products, events, news (administrative), special offers (shopping, restaurants, education), services available during a certain period;
Events of interest organized for the benefit of the residents of Stejarii – Residential Club and Stejarii Collection.

Personal data – any information regarding an identified or identifiable natural person (“data subject”); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more many specific elements, specific to his/her identity. II. ACCEPTANCE OF THE “TERMS AND CONDITIONS”

Before using Stejarii mobile application, please read carefully the provisions of this document. They establish the terms and conditions of your use of all the materials that make up Stejarii mobile application. Accessing and using the Application implies acceptance of the published Terms and Conditions, all of which have full contractual value between the parties. Also, please read the Privacy Policy, as it provides the relevant information regarding the processing of your personal data as Users of Stejarii Application.

Masterange reserves the right to modify the content of the Application at any time. In this situation, Masterange will notify users by displaying the changes on a page or message that will appear when accessing the Application. The continued use of the Application by the user represents an affirmative response of acceptance of the changes made to it.

III. CONTENT OF THE APPLICATION

The content, as defined, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented in the Application, are the exclusive property of the company Masterange, which reserves all rights obtained in this regard, directly or indirectly (through licenses for use and/or publication).

Users are not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, display, include any content in any context other than the original.

The information published in Stejarii Application is information of general interest about Masterange, the products sold by its partners, as well as other information considered by Masterange as being of interest to users of the mobile Application, residents of Stejarii Residential Club, Stejarii Collection and their guests.

Masterange reserves the right to complete and modify any information from Stejarii mobile application.

Masterange reserves the right to correct any omissions or display errors that may occur as a result of typing errors, lack of accuracy or software product errors, without prior notice.

IV. COPYRIGHT

The content of Stejarii mobile application – images, texts, graphics, symbols, WEB graphic elements, scripts, programs and other data – is the property of Masterange and its suppliers and is protected by the copyright protection law.

Therefore, the use for commercial purposes, without the consent of Masterange, of any of the elements listed above is punishable according to the laws in force.

V. ACCESS

The use of Stejarii mobile application is exclusively dedicated to the residents of Stejarii Residential Club and Stejarii Collection, as well as their guests (including children) based on a user and a password, after accepting the terms and conditions of use, as well as after reading the Privacy Policy.

VI. LINKS

Stejarii mobile application may host links to other World Wide Web sites or other resources. The responsibility for these sites rests entirely with their owners.

Masterange does not undertake responsibility for any damage or loss caused or alleged to be caused by the information provided by the sites or resources to which these links are sent.

VII. DISCLAIMER OF LIABILITY

Part of the content of Stejarii mobile application, namely the texts, product descriptions, their technical characteristics, their images and symbols, is made available to us by the manufacturers and partner suppliers. For this reason, Masterange does not undertake responsibility for damages caused by errors, lack of accuracy or non-updated information published or maintained in the Application.

The images presented in Stejarii mobile application have an exemplary role, and the products and/or services actually delivered may be different compared to the existing images in the Application, in any way (configuration, color, accessories, appearance, environment, etc.)

Masterange does not guarantee the availability in stocks of all the products displayed in the promotions available in Stejarii Application.

Masterange is not responsible for printing or display errors in the prices, features, images, products or services displayed in Stejarii Application.

Masterange is not responsible for damages, costs, lawsuits, claims or expenses arising as a result of non-compliance by users with the “Terms and Conditions”.

Masterange is not responsible for damages caused as a result of the Application not functioning as well as for those resulting from the impossibility of accessing certain links displayed therein.

VIII. FRAUD

ANY ATTEMPT TO ACCESS THE PERSONAL DATA OF ANOTHER USER, TO MODIFY THE CONTENT OF STEJARII APPLICATION OR TO AFFECT THE FUNCTIONING OF ANY SERVER HOSTING THE APPLICATION WILL BE CONSIDERED AN ATTEMPT TO FRAUD THEM AND MAY HAVE AS CONSEQUENCE ENTAILING THE LIABILITY OF THE AUTHOR OR AUTHORS OF THESE FACTS.
